1. Acceptance of Terms
By accessing or using the Muse In Motion platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you ("User," "you") and Muse In Motion ("Muse," "we," "us").
2. Eligibility
You must be at least 18 years old to use the Service. By creating an account, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. We reserve the right to request age verification at any time.
3. Description of Service
Muse In Motion provides an AI-powered management platform for digital content creators and their agencies. The Service includes:
- AI-assisted chat response generation
- Fan relationship management (CRM) and behavioral insights
- Multi-platform integration (OnlyFans, Fanvue, Fansly)
- Campaign management and automated messaging tools
- Analytics and performance dashboards
- Chrome extension for in-platform assistance
4. Account Responsibilities
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Ensuring team members you invite comply with these Terms
- Notifying us immediately of any unauthorized access
We reserve the right to suspend or terminate accounts that violate these Terms.
5. AI-Generated Content
Disclaimer: AI-generated chat responses are suggestions only. They are provided "as-is" without warranty of accuracy, appropriateness, or fitness for any particular purpose.
- You (the agency/operator) are solely responsible for reviewing and approving AI-generated messages before sending them to fans
- Muse is not liable for any consequences arising from AI-generated content that you choose to send
- AI responses do not constitute legal, financial, medical, or professional advice
- We do not guarantee any specific revenue, engagement, or conversion outcomes from using AI features
6. Acceptable Use
You agree not to use the Service to:
- Generate, store, or distribute content involving minors in any sexual context
- Create non-consensual intimate imagery or deepfakes
- Engage in or facilitate illegal activities
- Harass, threaten, or harm any person
- Violate the terms of service of connected platforms (OnlyFans, Fanvue, Fansly)
- Attempt to reverse-engineer, decompile, or extract our AI models
- Circumvent security measures, rate limits, or access controls
- Use automated tools to scrape data from the Service
- Share your account credentials or API keys with unauthorized parties
Violation of these rules may result in immediate account termination without refund.
7. Content Removal and TAKE IT DOWN Act Compliance
In compliance with the TAKE IT DOWN Act and applicable laws:
- We will process removal requests for non-consensual intimate imagery within 48 hours of receiving a valid notice
- To submit a removal request, email [email protected] with details of the content to be removed
- We cooperate with law enforcement when required by law
8. Intellectual Property
8.1 Your Data
You retain all ownership rights to your data, including fan communications, subscriber lists, media content, and business information. We do not claim ownership of your data.
8.2 Our Platform
The Service, including its AI models, algorithms, software, design, and documentation, is owned by Muse In Motion and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our platform.
8.3 AI Training
We may use anonymized and aggregated usage patterns to improve our AI models. We will never use your identifiable chat data, fan information, or media content for AI training without your explicit written consent.
9. Platform Compliance
You are solely responsible for ensuring that your use of the Service complies with the terms of service of any connected platforms, including but not limited to OnlyFans, Fanvue, and Fansly. Muse is not responsible for any penalties, bans, or consequences imposed by these platforms.
OnlyFans, Fanvue, and Fansly are trademarks of their respective owners. Muse In Motion is not affiliated with, sponsored by, or endorsed by any of these platforms.
10. Payment and Billing
- Fees are specified in your service agreement or pricing plan
- We do not take a percentage of your subscription revenue
- All fees are non-refundable unless otherwise stated in your agreement
- We reserve the right to modify pricing with 30 days' advance notice
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MUSE IN MOTION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold Muse In Motion harmless from any claims, damages, liabilities, costs, and expenses (including legal fees) arising from:
- Your use of the Service
- Content you create, send, or distribute using the Service
- Your violation of these Terms
- Your violation of third-party rights or applicable laws
13. Account Termination
- You may terminate your account at any time by contacting us
- We may suspend or terminate your account for violation of these Terms
- Upon termination, we will delete your data within 30 days (see our Privacy Policy for details)
- Sections 8, 11, 12, and 15 survive termination
14. Modifications to Terms
We may modify these Terms at any time. Material changes will be communicated via email or an in-platform notice at least 15 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws principles. Any disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.
